Property Settlement Agreements
licensed to practice in virginia and the district of columbia
The name can be deceiving because in many instances, a Property Settlement Agreement is the document which resolves custody and visitation arrangements, support obligations, and many other issues beyond just the division of property. They are often also referred to as Marital Settlement Agreements, PSA’s, or Property Settlement and Separation Agreements among other names. But the objective is the same regardless of the title: they resolve by agreement the incidents of marriage that would otherwise be determined by a Court.
Most divorce cases, even highly contested matters, end up being resolved by settlement rather than a Court. A carefully crafted Property Settlement Agreement is pivotal to protecting a client’s long-term interests. It is not uncommon for attorneys to spend the majority of their time in a divorce case gathering the information necessary to prepare a Property Settlement Agreement and negotiating its terms.
