In many instances a Separation Agreement is nothing more or less than a Property Settlement Agreement. But in the context addressed here a Separation Agreement is a more limited version of a Property Settlement Agreement that resolves fewer issues. Because it is not always possible to resolve all issues from the very onset of a case by agreement, Separation Agreements can serve as the first step, at times documenting nothing more than the date the parties separated. In other cases, the Separation Agreement will provide the interim or temporary agreed terms while the parties and their attorneys work on more permanent or comprehensive arrangements.

Separation Agreements can be an effective means of establishing some general temporary rules to provide assurances on any number of issues, while allowing the time and opportunity for all involved to learn what they need to know to resolve all matters on a more permanent basis.
